You must tell us immediately if you believe that your account is being used without your authority, or if you believe the security of your account information is compromised.
You are responsible for all activity on your account, including, as examples only, all purchases made.
Please check that all information you give us for your account is accurate and complete. Please tell us promptly if any of that changes. You are able to amend your own details when you log on to your account.
(We may, at any time, and without having to give any reason, suspend, modify or close accounts.)
When you place an order with Us, You are offering to buy the service that You order. There is no commitment on Us to supply this service at that price, or at all, until we decide to accept your order.
The service is sold subject to availability and subject to these Terms and Conditions. These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with Assay Office Birmingham prior to purchase, as purchase of the service constitutes acceptance of these Terms and Conditions. A valid receipt must be produced when attending a visit or Training Course.
We may send an email to you to confirm that we have received your booking/order and are processing it. That email is not a confirmation that we have accepted your order. There is no legally binding contract at that stage.
When we have received your payment and processed the booking/order we will send an email with your receipt to tell you we have accepted your order. There is then a binding contract. We remain free to decline all or part of your booking at any time before we decide to accept it. We will send an email to tell you if we decide to decline your booking (or part of it).
It is Your responsibility to check booking / order as if You have made a mistake it cannot always be rectified after purchase. Please check booking / order on receipt carefully and contact Us immediately if there is a mistake.
We will not be responsible for any booking receipt that is lost, stolen or destroyed.
Duplicate booking/order receipts may be issued at the discretion of Assay Office Birmingham. If duplicates are being issued, a reasonable administration charge may be levied.
We reserve the right to provide alternative booking appointments/orders to those specified on the booking/order receipt, provided they are of no less value and time duration to that stated on the original booking/order receipt.
Ownership or possession of a booking/order receipt does not confer any rights (by implication or otherwise) on You to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the booking/order receipt.
We may pass your details to third parties for address, identity and credit checks. That helps protect You and Us from fraud.
The price of the booking/service shall be the price set at the time We accept Your order. We use Our best efforts to ensure that the prices of bookings/services are correct at the time when the relevant information was entered onto the system. It is always possible that, despite Our best efforts, some of the bookings/services on Our site may be incorrectly priced. If We discover an error in the price of the booking /service You have ordered We will contact You to inform You of this error and will not process Your order until We have Your instructions. If We are unable to contact You using the contact details You provided during the order process, We will treat the order as cancelled and notify You in writing.
No order will be accepted until We have received full payment.
The price and delivery charges will be shown at checkout.
We quote the price inclusive of VAT. We will charge you the price inclusive of VAT, at the rate applying at the time of delivery. VAT is currently (January 2011) 20%.
You must pay for the booking/service and delivery when you place your order.
You must pay by MasterCard, Visa, Visa Delta or Switch card. We regret we are unable to accept other means of payment.
Booking/service receipts will only be delivered to the billing email address of the debit/credit card holder unless we specifically offer You the facility for bookings/services to be sent to an alternative address.
Assay Office Birmingham reserves the right to make alterations to the published booking programme/services where reasonably necessary.
In the unlikely circumstances that a booking event/service is cancelled or re-scheduled, We will use our reasonable endeavours to notify You of the cancellation as soon as is reasonably practical. We will use the details You provided Us with at the time of ordering. We do not guarantee that you will be informed of such cancellation before the date of the event booking/service.
It is Your responsibility to inform Us of any change to the contact address, telephone number or email address You provide Us with at the time of ordering.
Assay Office Birmingham bookings/services cannot be amended, exchanged or refunded after purchase. Where an event/service is cancelled or rescheduled by Assay Office Birmingham the booking will be transferred. We shall not be liable to make any refund or pay any compensation for any pre-booked travel or accommodation associated with the booking/service.
These Terms and Conditions do not and shall not affect Your statutory rights as a consumer.
Personal arrangements including travel, accommodation or hospitality relating to the booking/service which have been arranged by you are at your own risk.
Any event booking/service orders obtained in breach of these Terms and Conditions shall be void and all rights conferred or evidenced by such event booking/service shall be void. We reserve the right to cancel bookings/services which We reasonably suspect to have been made fraudulently. Void bookings/services are non-refundable.
We intend to rely on the written terms set out here in this document. You should read the Terms and Conditions carefully before entering into the contract to ensure that they contain everything that You consider has been agreed. After the contract has been made, these Terms and Conditions cannot be varied or amended in any respect unless both You and We agree in writing.
All booking/service orders that You place with Us will be on these terms (or any that we may issue to replace them). By placing a booking/service order with Us, You are expressly waiving any printed terms You may have to the extent that they are inconsistent with Our terms.
For the purposes of these Terms and Conditions, “Force Majeure” means any cause beyond Our reasonable control including, without limitation, act of god, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. We will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force majeure.
We shall be entitled to assign any of Our rights and obligations under these Terms and Conditions provided that Your rights are not adversely affected.
If it is found by a Court that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.
These Terms and Conditions constitute the entire agreement between the parties in connection to its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties.
Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms and Conditions or not) other than as expressly set out in these Terms and Conditions.
Nothing in this clause shall operate to limit or exclude any liability for fraud.
These Terms and Conditions shall be governed by and construed in all respects in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
English Law is applicable to any contract made under these terms. The English and Welsh courts have non-exclusive jurisdiction.
The only statements upon which You may rely in making the contract with Us are those made in writing by someone who is (or whom you reasonably believe to be) Our authorised representative and either:
contained in Our estimate (or any covering letter) and not withdrawn before the contract is made; or which expressly state that You may rely on them when entering into the contract.
Nothing in these Terms of Trade shall affect the Customer’s statutory rights
We may change anything on Our website at any time, at Our discretion.
We have no responsibility for the content of any websites other than Our own, even if Our site links to other websites.
We retain all rights to Our website design and all images on it. We have copyright and other rights to the design, look, style, appearance and content of it. You may view and print the website only as a buyer or potential buyer from us. You may not modify, publish, reproduce, distribute or broadcast in any format any material found within this site.
